1. General provisions

This Privacy Policy (the “Policy”) describes how ИП Королев (IE Korolev), IIN 780618050523 (the “Operator”), processes and protects the personal data of users of the videocut.kz service (the “Service”).

Personal data is processed in accordance with the Law of the Republic of Kazakhstan No. 94-V of 21 May 2013 “On Personal Data and Its Protection” (the “Law”) and other regulatory legal acts of the Republic of Kazakhstan.

Key terms are used with the meanings established by the Law: a personal data subject is an individual to whom the personal data relates; an operator is a person that collects, processes and protects personal data; a third party is a person that is neither the subject, the owner nor the operator, but takes part in the processing on their instructions.

The Operator acts simultaneously as the owner and the operator of the database containing personal data.

2. What personal data is collected

The Operator collects the minimum necessary amount of data:

• on registration: email address and name (at the user’s discretion);
• when placing an order: the public link to the video submitted for processing;
• automatically: IP address, browser type and version, cookies, Service access logs, and the date and time of the user’s actions;
• proof of consent: the date, time and IP address from which consent to the processing of personal data was given.
• when contacting the support chat: the text of the message written by the user.

The Operator does not collect special categories of personal data (racial or ethnic origin, political opinions, religious beliefs, health, or sex life) and does not request copies of identity documents, passwords to third-party accounts, or payment card details.

3. Purposes of processing

• registration and authentication of the user in the Service;
• provision of the automatic video clipping service and delivery of the result;
• communication with the user regarding orders and technical support;
• ensuring the information security and operability of the Service and preventing abuse;
• compliance with obligations under the legislation of the Republic of Kazakhstan.

Personal data is not used for automated decision-making that produces legal effects concerning the subject.

4. Legal grounds and consent

Processing is carried out on the basis of the consent of the personal data subject, as well as for the performance of a contract to which the subject is a party (the Operator’s public offer).

Consent is given by the user explicitly and voluntarily, by ticking the “I consent to the processing of personal data” checkbox during registration in the Service. The Operator records the date, time and IP address at which consent was given.

Withdrawal of consent. The subject may withdraw consent at any time by sending a request to info@videocut.kz. Following withdrawal of consent, the Operator ceases processing and destroys the personal data, except where its retention is expressly required by the legislation of the Republic of Kazakhstan. Withdrawal of consent makes further provision of services through the Service impossible.

5. Place of data storage

In accordance with the requirements of the Law, the database containing personal data is located and stored within the territory of the Republic of Kazakhstan, on a server leased by the Operator from a hosting provider in the Republic of Kazakhstan.

If the user is located outside the Republic of Kazakhstan, storing their personal data on the Operator’s server constitutes a cross-border transfer of such data to the territory of the Republic of Kazakhstan. By registering with the Service and placing an order, the user consents to such transfer and to the processing of personal data for the purpose of providing the services.

6. Transfer to third parties and cross-border transfer

For the automatic processing of video, the Service engages external services (technology service providers) acting on the Operator’s instructions. When an order is processed, the video link submitted by the user and the technical data of the order are sent to such services, including outside the Republic of Kazakhstan (cross-border transfer of personal data).

Such transfer is carried out with the user’s consent, which is given during registration in the Service. Without this consent the services cannot be provided. The Operator engages only those external services that ensure the protection of the transferred data, and discloses to them the minimum necessary amount of information.

Separately from order processing, technical data about visits to the website is transferred to website statistics services, including outside the Republic of Kazakhstan. The scope of such data and the way to opt out of it are described in section 7.

In all other cases the Operator does not transfer personal data to third parties, except for transfers to state authorities of the Republic of Kazakhstan on the grounds and in the manner established by law.

6.1. Support chat

The Service may operate a support chat that answers questions about how the Service works automatically. When a message is sent to the chat, the text of the question and information about the user's remaining Minutes balance are transferred to an external text-processing service, including outside the Republic of Kazakhstan. No other personal data, and no information about specific Orders or payments, is transferred to the chat: questions concerning a specific Order or payment are passed to an employee of the Operator.

Use of the chat is not mandatory: declining to use it does not affect the ability to place Orders or receive services. Consent to the transfer described in this clause is given by sending a message to the chat and may be withdrawn by ceasing to use it.

The Operator recommends not including personal data in the message text beyond what is required to answer the question.

7. Cookies and website statistics

The Service uses technical cookies necessary for authentication (session), interface language selection, theme selection and CSRF protection.

Referral source. The Service stores in its own cookies which link brought you here: the advertising campaign tags from the page address and the domain of the site you came from. The Operator needs this to understand which advertising works. This information is not shared with third parties and is not used to show you ads. The IP address, the full page address and the path on the third-party site are not stored for this purpose. The cookies live for 90 days; on registration the information is transferred to your account and is deleted together with it.

In addition, the Service uses analytics cookies of third-party website statistics services — Yandex.Metrica (Yandex) and Google Analytics (Google LLC, USA). They provide the Operator with depersonalised statistics: the number of visitors, referral sources, pages viewed and device type. These services receive the IP address, browser and device information, the addresses of the pages viewed and a cookie identifier; such transfer is cross-border (see section 6). Recording of the user’s actions on the page — mouse movements and input into form fields (Webvisor and similar tools) — is not enabled.

The Service does not use third-party advertising cookies and does not pass data to advertising networks.

Analytics cookies are enabled only with the user’s consent. On the first visit the Service shows a choice prompt; until the “Accept statistics” button is pressed the counters are not loaded and no data is sent to Yandex.Metrica or Google Analytics. The choice is remembered for one year in a technical cookie named cookie_consent.

Consent may be withdrawn at any time via the “Cookie settings” link in the footer of any page — after choosing “Necessary only” the counters stop loading. The official opt-out tools of the services themselves are also available: the Yandex.Metrica Opt-out browser add-on and the Google Analytics Opt-out Browser Add-on.

Technical cookies can be disabled in the browser settings, but signing in to the personal account will then become impossible.

8. Retention period and destruction

Personal data is stored for the duration of the use of the Service and thereafter for the period established by the legislation of the Republic of Kazakhstan for documents relating to the provision of services.

Personal data is destroyed by the Operator in the cases provided for by the Law: upon achievement of the purposes of processing, upon withdrawal of the subject’s consent, at the subject’s request, and upon detection of unlawful processing. Destruction is carried out within the time limits established by the Law, with notification to the subject.

The source video uploaded by the user is stored on the Operator’s server located in the territory of the Republic of Kazakhstan for the retention period of the processing result established by the public offer, after which it is deleted irrecoverably. If an Order is cancelled, not performed or rejected, the source video is deleted irrecoverably once the Order has ended, without waiting for that period. The basis for processing is the performance of the contract. The warranty that the rights to the source video and to the images of individuals contained in it are held rests with the user in accordance with the public offer.

If the user has selected a fragment of the recording for processing, the source video is downloaded in full — this is required in order to extract the fragment — and immediately after the fragment has been extracted everything except the fragment is deleted irrecoverably. Further storage and processing concern only the selected fragment, within the periods stated above.

The speech transcript and the service records of processing (recognised text with timestamps, the selected fragments, the styling parameters) are stored for 90 calendar days from the date the processing result is made available, after which they are deleted. This period is longer than the retention period of the processing result because it is required in order to examine the user’s complaints about the quality of the service: without these records the merits of a complaint cannot be verified. The source video itself is not retained for this period and is deleted together with the processing result.

Processing of the uploaded video and of materials derived from it may be carried out using computing capacity located outside the Republic of Kazakhstan. The user’s personal data is not transferred outside the Republic of Kazakhstan in doing so and is stored in the territory of the Republic of Kazakhstan.

9. Security measures

The Operator takes organisational and technical measures to protect personal data against unlawful access, alteration, disclosure and destruction:

• encryption of the connection (HTTPS/TLS) during data transmission;
• storage of passwords exclusively as irreversible hashes;
• access control; only the Operator has access to the data;
• platform-level protection against CSRF and XSS attacks and SQL injection;
• maintenance of access logs and regular backups.

10. Rights of the personal data subject

In accordance with the Law, the subject has the right to:

• know whether the Operator holds their personal data and obtain access to it;
• require the amendment, supplementation, blocking or destruction of their data if it is incomplete, inaccurate, outdated or obtained unlawfully;
• withdraw consent to processing;
• require the Operator to explain the conditions of processing;
• protect their rights and legitimate interests, including by appealing against the Operator’s actions to the authorised body for the protection of personal data of the Republic of Kazakhstan or through the courts.

Requests should be sent to info@videocut.kz. The Operator reviews the request and responds within the time limits established by the Law.

11. Data of minors

The Service is not intended for persons under 18 years of age. The Operator does not deliberately collect the personal data of minors. If such data is identified, it is destroyed.

12. Changes to the Policy

The Operator may amend this Policy. The current version is always available on this page, with the effective date indicated. Material changes are communicated to users by email.

The Policy is published in the Kazakh, Russian and English languages. In the event of any discrepancy between the versions, the rule of clause 17.2 of the Public Offer applies.
