Privacy Policy

1. General provisions

This Privacy Policy (the “Policy”) describes how ИП Королев (IE Korolev), IIN 780618050523 (the “Operator”), processes and protects the personal data of users of the videocut.kz service (the “Service”).

Personal data is processed in accordance with the Law of the Republic of Kazakhstan No. 94-V of 21 May 2013 “On Personal Data and Its Protection” (the “Law”) and other regulatory legal acts of the Republic of Kazakhstan.

Key terms are used with the meanings established by the Law: a personal data subject is an individual to whom the personal data relates; an operator is a person that collects, processes and protects personal data; a third party is a person that is neither the subject, the owner nor the operator, but takes part in the processing on their instructions.

The Operator acts simultaneously as the owner and the operator of the database containing personal data.

2. What personal data is collected

The Operator collects the minimum necessary amount of data:

• on registration: email address and name (at the user’s discretion);
• when placing an order: the public link to the video submitted for processing;
• automatically: IP address, browser type and version, cookies, Service access logs, and the date and time of the user’s actions;
• proof of consent: the date, time and IP address from which consent to the processing of personal data was given.

The Operator does not collect special categories of personal data (racial or ethnic origin, political opinions, religious beliefs, health, or sex life) and does not request copies of identity documents, passwords to third-party accounts, or payment card details.

3. Purposes of processing

• registration and authentication of the user in the Service;
• provision of the automatic video clipping service and delivery of the result;
• communication with the user regarding orders and technical support;
• ensuring the information security and operability of the Service and preventing abuse;
• compliance with obligations under the legislation of the Republic of Kazakhstan.

Personal data is not used for automated decision-making that produces legal effects concerning the subject.

4. Legal grounds and consent

Processing is carried out on the basis of the consent of the personal data subject, as well as for the performance of a contract to which the subject is a party (the Operator’s public offer).

Consent is given by the user explicitly and voluntarily, by ticking the “I consent to the processing of personal data” checkbox during registration in the Service. The Operator records the date, time and IP address at which consent was given.

Withdrawal of consent. The subject may withdraw consent at any time by sending a request to videocut.kz@gmail.com. Following withdrawal of consent, the Operator ceases processing and destroys the personal data, except where its retention is expressly required by the legislation of the Republic of Kazakhstan. Withdrawal of consent makes further provision of services through the Service impossible.

5. Place of data storage

In accordance with the requirements of the Law, the database containing personal data is located and stored within the territory of the Republic of Kazakhstan, on a server leased by the Operator from a hosting provider in the Republic of Kazakhstan.

If the user is located outside the Republic of Kazakhstan, storing their personal data on the Operator’s server constitutes a cross-border transfer of such data to the territory of the Republic of Kazakhstan. By registering with the Service and placing an order, the user consents to such transfer and to the processing of personal data for the purpose of providing the services.

6. Transfer to third parties and cross-border transfer

For the automatic processing of video, the Service engages external services (technology service providers) acting on the Operator’s instructions. When an order is processed, the video link submitted by the user and the technical data of the order are sent to such services, including outside the Republic of Kazakhstan (cross-border transfer of personal data).

Such transfer is carried out with the user’s consent, which is given during registration in the Service. Without this consent the services cannot be provided. The Operator engages only those external services that ensure the protection of the transferred data, and discloses to them the minimum necessary amount of information.

In all other cases the Operator does not transfer personal data to third parties, except for transfers to state authorities of the Republic of Kazakhstan on the grounds and in the manner established by law.

7. Cookies

The Service uses technical cookies necessary for authentication (session), interface language selection, theme selection and CSRF protection. Third-party advertising and tracking cookies are not used. The user may disable cookies in the browser settings, but signing in to the personal account will then become impossible.

8. Retention period and destruction

Personal data is stored for the duration of the use of the Service and thereafter for the period established by the legislation of the Republic of Kazakhstan for documents relating to the provision of services.

Personal data is destroyed by the Operator in the cases provided for by the Law: upon achievement of the purposes of processing, upon withdrawal of the subject’s consent, at the subject’s request, and upon detection of unlawful processing. Destruction is carried out within the time limits established by the Law, with notification to the subject.

The source video uploaded by the user is stored on the Operator’s server located in the territory of the Republic of Kazakhstan for the retention period of the processing result established by the public offer, after which it is deleted irrecoverably. The basis for processing is the performance of the contract. The warranty that the rights to the source video and to the images of individuals contained in it are held rests with the user in accordance with the public offer.

Processing of the uploaded video and of materials derived from it may be carried out using computing capacity located outside the Republic of Kazakhstan. The user’s personal data is not transferred outside the Republic of Kazakhstan in doing so and is stored in the territory of the Republic of Kazakhstan.

9. Security measures

The Operator takes organisational and technical measures to protect personal data against unlawful access, alteration, disclosure and destruction:

• encryption of the connection (HTTPS/TLS) during data transmission;
• storage of passwords exclusively as irreversible hashes;
• access control; only the Operator has access to the data;
• platform-level protection against CSRF and XSS attacks and SQL injection;
• maintenance of access logs and regular backups.

10. Rights of the personal data subject

In accordance with the Law, the subject has the right to:

• know whether the Operator holds their personal data and obtain access to it;
• require the amendment, supplementation, blocking or destruction of their data if it is incomplete, inaccurate, outdated or obtained unlawfully;
• withdraw consent to processing;
• require the Operator to explain the conditions of processing;
• protect their rights and legitimate interests, including by appealing against the Operator’s actions to the authorised body for the protection of personal data of the Republic of Kazakhstan or through the courts.

Requests should be sent to videocut.kz@gmail.com. The Operator reviews the request and responds within the time limits established by the Law.

11. Data of minors

The Service is not intended for persons under 18 years of age. The Operator does not deliberately collect the personal data of minors. If such data is identified, it is destroyed.

12. Changes to the Policy

The Operator may amend this Policy. The current version is always available on this page, with the effective date indicated. Material changes are communicated to users by email.
